Enforcement Guidance for Township Officials

As local officials continue to be the “boots on the ground” in helping communities be safe in this trying time, PSATS wants to share some additional guidance from the Commonwealth to assist in the enforcement of the orders that Gov. Tom Wolf and the Secretary of Health issued this week requiring all non-life sustaining businesses to close.

While all local officials can be “eyes and ears” to encourage compliance, enforcement matters should be performed in accordance with these guidelines.  Please coordinate referrals for enforcement to your law enforcement provider.  Enforcement will begin Monday, March 23 at 12:01 a.m. and Gov. Wolf is asking local officials with existing enforcement authority, such as local police officers, to assist with this effort. These guidelines were already shared with local law enforcement through your county emergency management agency.

 

The guidance details the sections of law that may be used to enforce the orders, including applicable civil and criminal penalties. The document explains expectations for progressive enforcement, consistency, and prioritization of enforcement on businesses where people congregate.
